TERMS OF USE

Effective Date: September 17, 2026

These Terms of Use ("Terms") govern your access to and use of educationesports.com and the online content, forms, resources, and services made available by Education Esports, LLC ("Education Esports," "we," "us," or "our").

By accessing the website, submitting information, creating an account, registering for a program, or using an Education Esports service, you agree to these Terms.

If you are using the website or services on behalf of a school, district, college, university, company, or other organization, you represent that you have authority to act on its behalf.

1. ABOUT EDUCATION ESPORTS

Education Esports develops standards, resources, training, consulting, assessment processes, pilot programs, and institutional certification services for scholastic Esports.

Our work is designed to help institutions protect students, establish an educational purpose, operate responsibly, support fair competition, manage facilities and technology, develop students, and improve their programs over time.

Education Esports may provide:

  • Institutional Esports certification

  • Certification readiness and gap assessment

  • Program evaluation and evidence review

  • Corrective-action support

  • Consulting and implementation guidance

  • Training, courses, workshops, and professional development

  • Standards, manuals, templates, reports, and educational materials

  • Pilot programs and validation activities

  • Research, benchmarking, and program-improvement services

  • Partnership and subject-matter review opportunities

Specific services may be governed by an additional proposal, agreement, statement of work, order form, invoice, pilot agreement, data protection agreement, or certification manual.

If a separate written agreement conflicts with these Terms, the separate written agreement controls for that service.

2. ELIGIBILITY AND AUTHORITY

You must be at least 18 years old to enter into an agreement with Education Esports through the website.

Students and minors may participate in institutionally authorized programs, interviews, surveys, courses, or activities only when arranged through an institution or otherwise supported by appropriate authorization.

You may not submit an application, accept contractual terms, authorize payment, provide institutional evidence, or make representations on behalf of an organization unless you have authority to do so.

3. INFORMATIONAL PURPOSE OF THE WEBSITE

Website content is provided for general informational and educational purposes.

It does not constitute:

  • Legal advice

  • Regulatory advice

  • Medical or mental-health advice

  • Cybersecurity advice

  • Accreditation

  • Government approval

  • Institutional authorization

  • A guarantee of legal compliance

  • A guarantee of student safety

  • A guarantee of program performance

  • A guarantee of certification

Institutions remain responsible for complying with all applicable laws, regulations, institutional policies, publisher terms, league requirements, accessibility obligations, privacy requirements, employment rules, health and safety requirements, and other duties.

You should obtain advice from qualified professionals when legal, regulatory, safety, privacy, accessibility, cybersecurity, medical, or other specialized guidance is required.

4. PILOT AND DEVELOPMENTAL MATERIALS

Certain standards, scoring methods, courses, tools, assessments, or certification procedures may be identified as drafts, pilot materials, developmental resources, or materials under review.

Participation in a pilot, consultation, readiness review, training program, or standards-development activity does not mean that an institution or individual is certified.

Developmental materials may be revised based on expert review, pilot findings, evidence, changes in law or technology, and improvements to the certification process.

Only a written certification decision issued by authorized Education Esports personnel grants certification status.

5. CERTIFICATION SCOPE

Education Esports certification applies only to the institution, program, location or location set, student population, operating model, and activities identified in the approved certification scope.

Certification does not automatically apply to:

  • An entire institution

  • Every campus or location

  • Every esports activity

  • Individual employees, coaches, students, or volunteers

  • Products, vendors, publishers, leagues, or platforms

  • Affiliated or partner organizations

  • Activities excluded from the approved scope

The applicable certification manual, service agreement, and written certification decision define the controlling requirements and scope.

6. APPLICATIONS AND EVIDENCE

Applicants and participating institutions must provide information that is accurate, current, complete, attributable, and not misleading.

Institutions are responsible for:

  • Confirming their authority to apply or participate

  • Identifying the appropriate certification scope

  • Disclosing material exclusions, dependencies, risks, incidents, and known gaps

  • Providing authentic and representative evidence

  • Protecting confidential and student information

  • Using approved submission methods

  • Cooperating with reasonable verification

  • Correcting inaccurate information

  • Reporting material changes that may affect an assessment or certification

Education Esports may review documents, interview relevant participants, observe activities, inspect or evaluate systems and facilities, request demonstrations, sample records, seek clarification, and require additional evidence where reasonably necessary.

Submission of a document does not establish conformity if actual practice is inconsistent with that document.

7. STUDENT AND CONFIDENTIAL INFORMATION

Do not submit student records, account credentials, health information, disciplinary records, sensitive personal information, or confidential institutional evidence through general website contact forms.

Institutions should minimize and de-identify student information before submission whenever reasonably possible.

The institution is responsible for confirming that it has the authority to provide information to Education Esports. Additional confidentiality, data-protection, evidence-handling, or institutional requirements may be established in a separate agreement.

Education Esports may reject, return, restrict, quarantine, or securely delete information submitted through an inappropriate channel.

8. ASSESSMENT AND CERTIFICATION DECISIONS

Certification decisions are based on the applicable standards, evidence, verified practice, findings, scoring requirements, gating requirements, corrective-action status, and decision procedures in effect for the relevant review.

Education Esports may:

  • Request additional information or verification

  • Identify observations or nonconformities

  • Require corrective action

  • Withhold certification pending verified closure

  • Decline certification

  • Define conditions or limitations

  • Require reassessment

  • Review material program changes

  • Suspend or withdraw certification when justified

  • Correct administrative or factual errors

Completing an application, paying a fee, purchasing consulting, completing training, participating in a pilot, or receiving readiness support does not guarantee certification.

Certification decisions will not be bought, promised, or guaranteed through consulting, training, sponsorship, membership, technology purchases, referrals, or partnership arrangements.

9. CORRECTIVE ACTIONS AND APPEALS

Where applicable, institutions may be required to address findings through corrective-action plans and provide evidence of completion and effectiveness.

Appeals must follow the procedures, deadlines, evidence limits, and grounds established in the applicable certification manual or agreement.

An appeal is intended to address issues such as factual error, procedural error, undisclosed conflict, or misapplication of the standard. It is not a negotiation of the certification requirements.

Submitting an appeal does not authorize use of a certification mark or alter an existing certification status unless Education Esports states otherwise in writing.

10. CERTIFICATION STATUS AND CREDENTIAL USE

An institution may describe itself as certified only after receiving written authorization from Education Esports.

Any certification claim must accurately state the certified institution or program, approved scope, status, and validity period.

An institution may not:

  • Claim certification while an application is pending

  • Present pilot participation as certification

  • Present readiness consulting or training as certification

  • Imply that excluded programs, campuses, or activities are certified

  • Imply that Education Esports has certified an individual, vendor, product, league, or platform unless expressly stated

  • Alter a certificate, seal, badge, report, or certification mark

  • Continue using an expired, suspended, or withdrawn credential

  • Make misleading statements about findings, scores, status, or scope

Use of Education Esports certification names, seals, badges, marks, and statements is subject to written authorization and any applicable credential-use requirements.

Education Esports may require correction or removal of inaccurate or unauthorized claims.

11. CONSULTING, TRAINING, AND INDEPENDENCE

Education Esports may offer consulting, training, readiness support, professional development, and implementation guidance separately from certification assessment.

Purchasing or receiving these services does not guarantee certification or a particular score or decision.

Education Esports may use separate personnel, conflict disclosures, independent review, recusal, or other safeguards when reasonably necessary to preserve the integrity of certification decisions.

Institutions remain responsible for approving and implementing any recommendation.

12. FEES, BILLING, CANCELLATIONS, AND REFUNDS

Fees for applications, assessments, certification, renewals, consulting, courses, workshops, events, or other services will be described in the applicable proposal, agreement, invoice, registration page, or order form.

Unless otherwise stated in writing:

  • Fees are quoted in United States dollars

  • Payment is due according to the applicable invoice or agreement

  • Work may be paused for overdue amounts

  • Additional work outside the agreed scope may require additional fees

  • Travel or third-party expenses may be charged only as disclosed or agreed

  • Refund and cancellation terms are determined by the applicable service agreement or registration terms

Payment does not guarantee certification, approval, a particular finding, or a specific outcome.

13. INTELLECTUAL PROPERTY

The website and Education Esports materials, including standards, manuals, frameworks, scoring methods, course materials, templates, graphics, reports, text, logos, badges, trademarks, and other content, are owned by or licensed to Education Esports and are protected by applicable intellectual-property laws.

Unless Education Esports provides written permission, you may not:

  • Copy or republish substantial portions of our materials

  • Sell, sublicense, or commercially distribute our materials

  • Create an unauthorized competing certification from our standards or assessment tools

  • Remove copyright, trademark, confidentiality, or attribution notices

  • Modify or imitate a certificate, mark, seal, badge, or report

  • Use Education Esports branding in a manner that suggests an unauthorized relationship or status

  • Use confidential reviewer guidance, scoring tools, or assessment materials outside their authorized purpose

You may download or print publicly available materials for internal, noncommercial institutional evaluation, provided that notices remain intact and the material is not misrepresented.

Any broader permission must be provided in writing.

14. FEEDBACK AND SUBMISSIONS

If you voluntarily provide feedback, suggestions, or recommendations concerning our website, resources, standards, or services, you grant Education Esports permission to use that feedback to improve its work without compensation or attribution.

This does not authorize us to publicly identify a student, institution, confidential submission, or certification evidence without appropriate permission.

15. ACCEPTABLE USE

You may not use the website or services to:

  • Violate any law or another party’s rights

  • Submit false, fabricated, altered, or misleading evidence

  • Misrepresent identity, authority, certification status, or institutional affiliation

  • Access systems, records, or accounts without authorization

  • Introduce malicious code or interfere with website security

  • Scrape, extract, or systematically copy protected materials

  • Circumvent access restrictions

  • Harass, threaten, discriminate against, or harm another person

  • Submit information that you are not authorized to disclose

  • Infringe intellectual-property, privacy, or confidentiality rights

  • Use Education Esports materials or marks to create a false endorsement

  • Retaliate against a student, employee, reviewer, reporter, or participant

We may restrict or terminate access when we reasonably believe misuse has occurred.

16. THIRD-PARTY SERVICES AND LINKS

The website and our materials may reference or link to third-party websites, publishers, leagues, platforms, vendors, payment processors, learning systems, communication services, or other resources.

Education Esports does not control and is not responsible for independent third-party content, availability, security, privacy practices, products, or services.

A reference or link does not necessarily constitute endorsement, certification, approval, or partnership.

17. DISCLAIMERS

To the maximum extent permitted by law, the website and publicly available content are provided on an "as is" and "as available" basis.

Education Esports does not warrant that:

  • The website will always be available or error-free

  • Every piece of content will remain current

  • Every risk will be detected

  • Use of our materials will produce a particular result

  • An institution will qualify for certification

  • Certification will prevent all incidents, losses, misconduct, or legal violations

Certification provides an assessment of a defined program and scope using the applicable evidence and requirements at the time of review. It is not a guarantee of future conduct, performance, safety, compliance, or outcomes.

18. LIMITATION OF LIABILITY

To the maximum extent permitted by law, Education Esports and its owners, employees, contractors, reviewers, advisers, and representatives will not be liable for indirect, incidental, special, exemplary, consequential, or punitive damages arising from use of the website or services.

Where liability cannot be excluded, Education Esports’ aggregate liability will be limited to the amount paid to Education Esports for the specific service giving rise to the claim during the 12 months preceding the event, or one hundred dollars if no amount was paid, except where a different limitation is required by law or established in a separate written agreement.

Some jurisdictions do not permit certain limitations, so portions of this section may not apply to you.

19. INDEMNIFICATION

To the extent permitted by law, you and the organization you represent agree to defend, indemnify, and hold Education Esports harmless from claims, losses, liabilities, and reasonable expenses resulting from:

  • Your unlawful or unauthorized use of the website or services

  • Information or evidence you were not authorized to provide

  • Material misrepresentation or falsification

  • Unauthorized certification or trademark claims

  • Your violation of these Terms

  • Your violation of another party’s rights

This section does not require indemnification for conduct that cannot lawfully be indemnified.

20. SUSPENSION AND TERMINATION

We may suspend or terminate access to the website, materials, accounts, or services if:

  • These Terms are violated

  • Fees remain unpaid

  • Information is materially false or misleading

  • Security, privacy, safety, or integrity is threatened

  • Education Esports materials or credentials are misused

  • Continued service would violate law or an agreement

Suspension of website or account access is separate from suspension or withdrawal of certification, which is governed by the applicable certification requirements and written decision.

21. GOVERNING LAW AND DISPUTES

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.

Unless a separate written agreement provides otherwise, disputes relating to these Terms or the website will be brought in the state or federal courts located in San Diego County, California and each party consents to their jurisdiction.

Nothing in this section prevents either party from seeking emergency or injunctive relief where legally appropriate.

22. CHANGES TO THESE TERMS

We may update these Terms to reflect changes in our website, services, certification framework, business practices, or legal obligations.

Updated Terms will be posted with a revised effective date. Material changes may also be communicated through the website, email, an institutional contact, or another appropriate method.

Changes to an active paid service or certification engagement will remain subject to any controlling written agreement.

23. SEVERABILITY

If a provision of these Terms is found unenforceable, the remaining provisions will remain in effect, and the unenforceable provision will be interpreted as closely as legally permitted to its intended purpose.

24. ENTIRE AGREEMENT

These Terms and any applicable Privacy Policy, proposal, agreement, order form, invoice, pilot agreement, certification manual, or data protection agreement constitute the applicable agreement between you and Education Esports concerning the relevant website use or service.
